RESOLUTION

ON THE AMENDMENT OF RESOLUTION No 528 of 6 JUNE 2018 OF THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA “ON THE APPROVAL OF REGULATIONS OF STATISTICS LITHUANIA AND GRANTING POWERS“,

The Government of the Republic of Lithuania hereby r e s o l v e s:

To amend Resolution No 528 of 6 June 2018 of the Government of the Republic of Lithuania “On the approval of regulations of Statistics Lithuania and granting powers”:

1. To amend the preamble and to lay it down as following:

 “Pursuant to item 9 of Article 22, Part 4 of Article 291 of the Law on the Government of the Republic of Lithuania, item 1 of Part 3 of Article 4 of the Law on Budgetary Institutions of the Republic of Lithuania and Part 3 of Article 8 of the Law on Official Statistics of the Republic of Lithuania, the Government of the Republic of Lithuania hereby

r e s o l v e s the following:”

2. To amend the Regulations of the Lithuanian Department of Statistics approved by the above indicated Resolution and to lay them down in a new wording (enclosed).

REGULATIONS OF THE LITHUANIAN DEPARTMENT OF STATISTICS

CHAPTER I.
GENERAL PROVISIONS

1. The Lithuanian Department of Statistics (hereinafter referred to as "Statistics Lithuania") shall be a government agency.

2. Statistics Lithuania shall be a budgetary institution, legal entity code 188600177, having a bank account and a seal bearing the national emblem of Lithuania and the name of Statistics Lithuania. The address of the head office of Statistics Lithuania is: 29 Gedimino Ave., Vilnius.

3. Statistics Lithuania shall be maintained from the State budget of the Republic of Lithuania and from other funding sources laid down by legislation.

4. The owner of Statistics Lithuania shall be the State. The rights and duties of the owner of Statistics Lithuania shall be executed by the Government of the Republic of Lithuania, which shall perform the functions established in the Law on Budgetary Institutions of the Republic of Lithuania.

5. Public information of Statistics Lithuania shall be published on the website of Statistics Lithuania (www.stat.gov.lt), social communication internet websites “Facebook”, “LinkedIn” accounts and in other media laid down by legislation.

6. Statistics Lithuania shall act in the field of the management of statistics, assigned to the Minister of Finance. 

7. Concepts used in the Regulations of Statistics Lithuania (hereinafter referred to as “the Regulations”) shall be construed as they are defined in the Law on Official Statistics of the Republic of Lithuania and the Law on Management of State Information Resources of the Republic of Lithuania.

8. The Regulations of Statistics Lithuania shall be amended under the resolution passed by the Government.

CHAPTER II.
OBJECTIVES AND FUNCTIONS OF STATISTICS LITHUANIA

9. The objectives of Statistics Lithuania shall be:

9.1. to implement the common national policy in the field of the methodology and organisation of statistics;

9.2. to coordinate the organisation of official statistics, preparation of statistical information under Part I of the Work Programme of Official Statistics.

10. For the purpose of fulfilling the objectives established in sub-item 9.1, Statistics Lithuania shall perform the following functions:

10.1. establishment of statistical observation forms and modes;

10.2. preparation of statistical surveys under Part I of the Work Programme of Official Statistics;

10.3. preparation and approval of the plans of general censuses;

10.4. preparation and dissemination of statistical information to the users of official statistics, reflecting demographic, social and economic development trends and environmental changes in various forms and modes;

10.5. publication of statistical information on the Official Statistics Portal prepared under Part I of the Work Programme of Official Statistics;

10.6. release of the key comparative indicators of Lithuania and foreign countries;

10.7. provision of statistical information that is prepared not under Part I of the Work Programme of Official Statistics, if its preparation costs are defrayed;

10.8. contribution to achieving strategic objectives and implementation of progress challenges in different fields of the State activities;

10.9. introduction of new statistics-related international classifications, standards and methods in order to ensure preparation and dissemination of coherent and comparative statistical information; by order of the Government of the Republic of Lithuania, management of the Central Classification Database; 

10.10. application of the experience of foreign statistical offices;

10.11. cooperation with higher education schools and scientific research institutions;

10.12. participation in the activity of the European Union and international statistical organisations on the improvement and development of the European Union and international statistics, contribution to the implementation of statistical programmes of international organisations and development of international statistics;

10.13. implementation of organisational, technological and technical measures ensuring protection and confidentiality of statistical data, including personal data and special categories of data, as well as statistical information;

10.14. submission of proposals pertaining to draft legal acts on official statistics, provision of conclusions to other institutions or establishments on having an effect on the quality of such drafts and legal regulation in the field of official statistics;

10.15. preparation of position of the Republic of Lithuania in the European Union institutions and their working groups or commissions on the subject in question, as well as submission of conclusions and proposals pertaining to positions of other institutions and establishments;

10.16. representation of interests of the Republic of Lithuania in the European Union institutions and their working groups or commissions pertaining to official statistics.

11. For the purpose of fulfilling the objective established in sub-tem 9.2 hereof, Statistics Lithuania shall perform the following functions:

11.1. establishment of coordination and monitoring procedures of other institutions managing official statistics;

11.2. conclusion of agreements with other institutions managing official statistics pertaining to the organisation, quality assurance and dissemination of official statistics;

11.3. approval of guidelines for implementation of Part I of the Work Programme of Official Statistics by other institutions managing official statistics;

11.4. organisation of publication of statistical information and statistical indicators meta-information, prepared by other institutions managing official statistics, on the Official Statistics Portal;

11.5. coordination of the transmission of statistical data and (or) information, prepared by other institutions managing official statistics, to the Statistical Office of the European Union, international organisations;

11.6. coordination of  the development and dissemination of statistical indicators that are necessary for the implementation of the Agenda of the United Nations Conference on Sustainable Development by 2030.

12. For the purpose of fulfilling the objectives established, Statistics Lithuania shall also perform the following functions:

12.1. establishment of the State Data Governance Information System, performance of the controller and the processor functions;

12.2. consideration of letters, inquiries, proposals, applications, complaints received by Statistics Lithuania from State and municipal authorities and agencies, other legal or natural persons;

12.3. initiation of administrative proceedings, conduct of administrative investigations, drawing up protocols of administrative offences, processing cases of administrative offences within the competence of Statistics Lithuania;

12.4. performance of functions laid down in Part 4 of Article 6 of the Law on Official Statistics of the Republic of Lithuania

CHAPTER III.
RIGHTS OF STATISTICS LITHUANIA

13. Pursuing the objectives and for the purpose of performing its functions, Statistics Lithuania shall have the following rights:

13.1. to receive information on the statistical surveys planned, which is required for the preparation of Part I of the Work Programme of Official Statistics, from other institutions managing official statistics, according to the form and on time reasonably set by Statistics Lithuania;

13.2. to receive information from other institutions managing official statistics and to disseminate it on the Official Statistics Portal;

13.3. to organise and carry out general censuses; to involve, for that purpose, interviewers, State and municipal authorities and agencies, if needed, in accordance with the procedure laid down by the Government of the Republic of Lithuania;

13.4. to provide statistical data for scientific purposes to higher education schools or scientific research institutions on a contract basis under the procedure laid down by the Director General of Statistics Lithuania;

13.5. to check whether the statistical data submitted by respondents were calculated following the approved methodologies;

13.6. if needed, to invite experts to provide expert assistance in the field of development and improvement of official statistics;

13.7. to perform other official statistics-related works under contracts with State and municipal authorities and agencies;

13.8. to conclude agreements with the Bank of Lithuania on the implementation of the Work Programme of Official Statistics and statistical investigations of the European  Statistical Programme carried out by the Bank of Lithuania;

13.9. to conclude bilateral and multilateral contracts and agreements with the European Union institutions, legal persons of the Republic of Lithuania and foreign states;

13.10. to carry out experimental (not included into Part I of the Work Programme of Official Statistics, to be performed by applying new statistical data-processing methods, pilot) statistical studies;

13.11. to invite representatives and experts from State and municipal authorities and agencies, non-state organisations, state enterprises for the consideration of issues to be solved by Statistics Lithuania, and to form special commissions and working groups;

13.12. other rights laid down in Article 5 and Part 5 of Article 6 of the Law on Official Statistics of the Republic of Lithuania.

14. Statistics Lithuania may have other rights laid down by legislation, related to its objectives and functions.

CHAPTER IV.
ORGANISATION OF ACTIVITY OF STATISTICS LITHUANIA

15. Statistics Lithuania in its activity shall follow the strategic and annual action plans prepared according to the procedure laid down by the Government of the Republic of Lithuania, which approval, implementation and monitoring of the implementation, evaluation of results and reporting on the results obtained shall be performed under the procedure laid down in the Law on Strategic Management of the Republic of Lithuania.

16. Statistics Lithuania shall be headed by Director General, who shall be appointed to and dismissed from office under the procedure laid down in the Law on Civil Service of the Republic of Lithuania.

17. The Director General of Statistics Lithuania shall approve the structure of the administration of Statistics Lithuania.

18. In the absence of the Director General of Statistics Lithuania, Director General shall be deputised for by First Deputy Director General, in the absence thereof – another Deputy Director General by order of the Director General.

19. The Director General shall supervise the administrative divisions of Statistics Lithuania directly or through deputies. Deputies of the Director General shall be directly subordinate and accountable to the Director General. Deputies of the Director General shall organise and control the work of the heads of the administrative divisions supervised by them, coordinate the activity of those divisions, perform other functions delegated by the Director General.

20. The Director General of Statistics Lithuania shall:

20.1. deal with issues within the competence of Statistics Lithuania; be directly responsible for the fulfilment of the objectives and proper performance of the functions necessary for the fulfilment thereof delegated to Statistics Lithuania;

20.2. monitor the implementation of legal acts regulating official statistics;

20.3. organise and coordinate the implementation of the assignments of the Government and the Prime Minister of the Republic of Lithuania;

20.4. issue orders, decisions and perform supervision of the implementation thereof;

20.5. appoint representatives to the working groups or commissions of the European Union and international organisations;

20.6. under the procedure laid down by the Government be held accountable for the activity of Statistics Lithuania, submit reports on his/her activity at the request of the Government or the Minister of Finance of the Republic of Lithuanian;

20.7. approve the regulations of the administrative divisions of Statistics Lithuania, lists of positions of the civil servants and employees working under an employment contract of Statistics Lithuania;

20.8. in accordance with the procedure laid down by legal acts regulating labour relations, appoint and dismiss deputies, other civil servants and employees working under an employment contract of Statistics Lithuania, motivate and impose disciplinary punishments upon them, grant them allowances, take other personnel management-related actions laid down by legislation in relation to them;

20.9. identify respective areas to be mentored (supervised) by Deputies of the Director General;

20.10. approve the internal regulations, working regulations, other internal administration documentation of Statistics Lithuania;

20.11. organise rational and cost-effective use of the funds and property of Statistics Lithuania, effective creation, development, functioning and improvement of the internal control system of Statistics Lithuania;

20.12. perform other functions laid down in Part 3 of Article 6 of the Law on Official Statistics of the Republic of Lithuania and other legal acts.

21. In accordance with the procedure laid down in Article 8 of the Law on Official Statistics of the Republic of Lithuania, form an advisory body to Statistics Lithuania – the Statistical Council, receiving technical support services from Statistics Lithuania. Institutional composition of the Statistical Council and the Regulations of the Statistical Council shall be approved by the Minister of Finance of the Republic of Lithuania, personnel composition – by the Director General of Statistics Lithuania.

22. The internal audit of Statistics Lithuania shall be performed by the Centralised Internal Audit Service of the Ministry of Finance of the Republic of Lithuania.

CHAPTER V.
FINAL PROVISIONS

23. Statistics Lithuania may be reorganised, liquidated or restructured in accordance with the procedure laid down by the Civil Code of the Republic of Lithuania, the Law on the Government of the Republic of Lithuania and the Law on Budgetary Institutions of the Republic of Lithuania.
